This Credit Check Consent Agreement (the "Agreement") constitutes your consent to allow Noma Financial Inc. ("Noma", "Company", "we", "our", or "us"), including all its products and services provided through brands like GetFlexi, GetWeekly, Xuro, QuipIt, and GetFlights (collectively, the "Service"), and all other related operating brands, to obtain and use your credit information from TransUnion for the purposes of providing financial services to you, including evaluating your eligibility for credit products and managing your account. Please read this Agreement carefully, as it contains important information regarding your rights and responsibilities. By providing your consent, you agree to the terms and conditions outlined below.

By using our services or applying for credit through Noma, you hereby authorize Noma to obtain and review your credit information from TransUnion, including but not limited to your credit report, credit score, and other financial information. This authorization extends to any updates to your credit information that we may request throughout the duration of your relationship with us.

Noma, along with all related operating brands, will use your credit information for purposes such as determining your eligibility for credit products, processing your application, verifying your identity, managing your account, assessing your creditworthiness, and meeting regulatory or risk management requirements.

Your consent to obtain and use your credit information is ongoing, meaning that Noma, including all related operating brands, may obtain your credit information from TransUnion at any time during the term of your account or relationship with us for the purposes described in this Agreement. This includes but is not limited to obtaining updated credit information for monitoring your account or making credit-related decisions.

You consent to Noma sharing your credit information with our affiliates, agents, service providers, and business partners as needed to provide and manage the services offered to you. This may include sharing your credit information for underwriting purposes, compliance with legal requirements, and risk management.

You authorize us to collect personal information, including your name, date of birth, address, and any other information required to obtain your credit information from TransUnion.

Noma will use the information collected to verify your identity, conduct credit checks, determine your eligibility for our products and services, and communicate with you regarding your account and applications.

Noma, including all related operating brands, may disclose your credit information and personal information to third parties, including regulatory authorities, our service providers, and agents, where necessary to provide our services, fulfill our regulatory obligations, or protect our interests.

You have the right to withdraw your consent to allow Noma Financial to obtain your credit information from TransUnion at any time. To withdraw your consent, please contact us at support@nomafinancial.com or call 855-562-6003. Please note that if you withdraw your consent, we may be unable to provide certain products or services to you, and your account may be closed or limited as a result.

You acknowledge that the accuracy of the credit information we obtain from TransUnion is dependent on the information provided to them by you and third parties. If you believe that any information on your credit report is inaccurate, you have the right to contact TransUnion directly to dispute the information.

By providing your consent to this Agreement, you acknowledge and agree that Noma may obtain and use your credit information from TransUnion as described herein. Your consent has the same legal effect as if you had signed a paper copy of this Agreement.

You agree that this consent may be provided electronically and that we may communicate with you electronically regarding your credit check and other matters related to your account.

Noma is not responsible for any errors or inaccuracies in the credit information provided by TransUnion. If you believe there are errors in your credit report, you are responsible for contacting TransUnion directly to resolve the issue.

To the fullest extent permitted by law, Noma shall not be liable for any damages, losses, or claims arising from our use of your credit information in accordance with this Agreement, including any reliance on inaccurate credit information provided by TransUnion.

This Agreement is governed by the laws of the province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ontario, Canada, for the resolution of any disputes arising out of or relating to this Agreement.

Noma reserves the right to modify or update this Agreement at any time. We will provide notice of any material changes to you via email or through our website. Your continued use of our services after such notice constitutes your acceptance of the modified Agreement.
